1. Acceptance of Terms
By accessing or using Marble Frame ("the Service"), operated by Marble Frame ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via the email associated with your account.
2. Description of Service
Marble Frame is an AI-powered website builder that allows users to:
- Generate static websites using artificial intelligence
- Host generated websites on secure cloud infrastructure with global content delivery
- Register custom domain names or connect externally-owned domains
- Upload and manage media assets for their websites
- Configure contact forms to receive visitor messages
- Update and iterate on their websites using AI-driven prompts
3. Account Registration
You must create an account to use the Service. You may register using email/password or a supported supported third-party provider (such as Google). You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service.
4. AI-Generated Content
Websites generated through the Service are created using AI technology. You acknowledge that:
- AI-generated content may not be unique and similar output may be produced for other users
- You are solely responsible for reviewing, editing, and approving all generated content before publishing
- We do not guarantee the accuracy, completeness, quality, or suitability of AI-generated content
- Generated content should be reviewed for compliance with applicable laws, including intellectual property, accessibility, and advertising regulations
- We are not liable for any claims arising from your use of AI-generated content
Subject to these Terms, you own the content generated for your websites. We retain no ownership rights to your generated website files, uploaded assets, or custom content.
5. AI Credits and Payments
Website generation and updates consume AI credits. Credits are purchased through the Service and are non-refundable once used. You agree that:
- Credit prices are listed in US Dollars and are subject to change with notice
- Credits are consumed at the time of generation, regardless of the output quality
- Unused credits do not expire but are non-transferable between accounts
- New accounts may receive complimentary starter credits at our discretion
- Coupon codes are single-use and subject to their specific terms
6. Domain Registration
6.1 Sponsoring Registrar
Marble Frame is not an ICANN-accredited domain registrar. Domain names registered through the Service are processed by Amazon Registrar, Inc., an ICANN-accredited registrar (IANA ID: 4399). Marble Frame acts as an interface to facilitate domain registration on your behalf. You can verify the sponsoring registrar for any domain by performing a WHOIS lookup at lookup.icann.org.
6.2 General Domain Terms
When you register a domain through the Service:
- Domain registration fees are non-refundable once the registration is submitted
- Domain pricing varies by TLD (top-level domain) and is displayed at the time of purchase
- Domain renewals are your responsibility; we enable auto-renewal but you should verify renewal status
- We are not liable for domain disputes, expiration, or transfer issues
6.3 Registrant Rights and Responsibilities
As the domain registrant, you are bound by the ICANN Registrar Accreditation Agreement and the policies referenced therein. You acknowledge and agree to the following:
- Accurate Registration Data: You must provide accurate, complete, and current contact information (including name, postal address, email, and phone number) at the time of registration and update it promptly if it changes. Willfully providing inaccurate or unreliable information, or failing to update it, constitutes a material breach and may result in cancellation of your domain registration.
- Registrant Data Use: Your registration data may be made publicly available via WHOIS/RDAP in accordance with ICANN policy, unless privacy protection is enabled and available for your TLD. You consent to the use of your data as required by ICANN for the administration of the domain name system.
- ICANN Registrant Educational Materials: ICANN publishes information about your rights as a registrant. You are encouraged to review the Registrant Rights and Responsibilities document.
6.4 Domain Dispute Resolution
You agree to be bound by the following ICANN dispute resolution policies, which are incorporated by reference:
- Uniform Domain-Name Dispute-Resolution Policy (UDRP): Disputes regarding alleged abusive domain name registrations (e.g., cybersquatting) are subject to the UDRP and its Rules of Procedure. You agree to submit to mandatory administrative proceedings if a complaint is filed against your domain name.
- Transfer Dispute Resolution Policy (TDRP): Disputes related to the transfer of domain registrations between registrars are subject to the TDRP.
- Registry-Specific Policies: Certain TLDs may have additional dispute resolution or eligibility policies imposed by the registry operator. You are responsible for understanding and complying with policies applicable to your chosen TLD.
6.5 Domain Transfers
You have the right to transfer your domain to another registrar, subject to ICANN's Transfer Policy. A domain transfer may be restricted during the first 60 days after registration or a previous transfer, as permitted by ICANN policy. To initiate a transfer, contact us or use the domain management controls available in your dashboard.
6.6 Domain Cancellation and Suspension
Your domain registration may be cancelled, suspended, or transferred in the following circumstances:
- You request cancellation
- You provide materially inaccurate contact information and fail to correct it
- You fail to respond to inquiries from the registrar regarding the accuracy of your registration data within 15 days
- A UDRP or court proceeding results in a cancellation or transfer order
- Your use of the domain violates applicable law, these Terms, or the Acceptable Use policy
- Non-payment of applicable fees
- As required by ICANN policy, a court order, or applicable law
6.7 Externally-Owned Domains
If you connect an externally-owned domain, you are responsible for configuring DNS records at your registrar. We provide the nameservers but do not guarantee DNS propagation timing.
7. Website Hosting
Published websites are hosted on secure cloud infrastructure. Hosting terms:
- Monthly hosting is billed as a recurring subscription
- You may pause or cancel hosting at any time from the Billing page
- Pausing hosting suspends public access to your website but preserves your files
- Cancellation will take effect at the end of the current billing period
- We reserve the right to disable hosting for accounts with overdue payments
- We do not guarantee 100% uptime and are not liable for service interruptions caused by infrastructure provider outages or maintenance
8. Acceptable Use
You agree not to use the Service to create, host, or distribute websites that:
- Violate any applicable local, state, national, or international law
- Infringe upon intellectual property rights of others
- Contain malware, phishing content, or deceptive practices
- Promote hate speech, violence, harassment, or discrimination
- Distribute illegal or controlled substances
- Engage in spam, scraping, or automated abuse of the Service
- Impersonate another person or entity
- Contain content that exploits or harms minors
We reserve the right to suspend or terminate accounts that violate this policy without prior notice or refund.
9. Intellectual Property
The Marble Frame platform, including its interface, branding, code, and documentation, is our proprietary property protected by copyright and trademark law. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
You retain ownership of content you create or upload, including website files, images, and text. By using the Service, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the Service.
10. Third-Party Services
The Service relies on trusted third-party providers for core functionality, including AI content generation, cloud hosting and infrastructure, payment processing, and authentication. Your use of the Service involves interaction with these providers, and their respective terms and privacy policies may apply.
We are not responsible for the availability, performance, or policies of third-party services.
11. Limitation of Liability
To the maximum extent permitted by law, Marble Frame and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from:
- Your use of or inability to use the Service
- AI-generated content errors or omissions
- Unauthorized access to your account or data
- Service interruptions or downtime
- Actions of third-party providers
Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
13. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use policy
- Your account has been inactive for an extended period
- Required by law or regulatory authority
- We discontinue the Service (with reasonable notice)
Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period to comply with legal obligations, after which it will be deleted.
14. Indemnification
You agree to indemnify, defend, and hold harmless Marble Frame and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, New York. You waive any right to participate in class action lawsuits or class-wide arbitration.
